Terms of Service

Terms of Use Effective date: January 25, 2026

These Terms of Use ("Terms") govern your access to and use of the Punpic website, apps, and related services (the "Service"). By using the Service, you agree to these Terms.

  1. Who we are Punpic provides AI-assisted tools that transform user-provided images using selected templates and AI providers.
  2. Eligibility You must be legally able to form a binding contract in your jurisdiction to use the Service. You are responsible for ensuring your use complies with applicable laws.
  3. Your account You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate account information.
  4. Tokens, purchases, and billing 4.1 Tokens Punpic uses digital credits ("Tokens") to access certain features (such as image generation). Token costs are displayed in the product UI and may vary by feature or quality setting. 4.2 Payments Payments are processed by Stripe. Punpic does not store your full payment card details. Your purchase may be subject to taxes and Stripe's processing rules. 4.3 No subscription Token purchases are one-time payments unless you are explicitly shown a subscription option in the future. 4.4 Refunds Token purchases are generally non-refundable because they are digital goods delivered electronically, except in cases of verified technical errors (see the Refund Policy).
  5. AI-generated content and no guarantees The Service uses AI. Outputs may be inaccurate, contain artifacts, or differ from expectations. Punpic does not guarantee any specific outcome, quality, or suitability for a particular purpose.
  6. Your content, rights, and responsibilities 6.1 You must have rights and consent You represent and warrant that you have all necessary rights, permissions, and consents to upload and use any content, including: ownership or a valid license for the uploaded image, consent from any identifiable person in the image (when required), permission to use the content for the purpose you choose (personal/commercial), and compliance with privacy, publicity, and intellectual property laws. You must not upload content that violates any third-party rights (copyright, trademark, privacy, publicity, etc.). 6.2 Prohibited content and misuse You agree not to use the Service to create, upload, generate, or distribute content that is illegal or harmful, including: content that infringes intellectual property or privacy rights, non-consensual intimate imagery, sexual content involving minors (strictly prohibited), harassment, threats, or defamation, fraud, impersonation, or deceptive use, attempts to bypass security, abuse rate limits, or disrupt the Service. We may suspend or terminate accounts for violations. 6.3 License to operate the Service To provide the Service, you grant Punpic a limited license to host, process, transmit, and display your uploaded content and generated outputs only as needed to operate and improve the Service, including sending data to AI/API providers to perform the requested transformation.
  7. Storage and visibility of content Uploaded images: Punpic is designed not to keep your uploaded source photos beyond what is necessary to process your request. Generated results: Generated images may be stored in your account history so you can view and download them, unless you delete them. (If a technical reason requires temporary caching or retention, it will be limited to what is necessary for service operation and security.)
  8. Intellectual property Punpic and its software, branding, and UI are owned by Punpic and/or its licensors. You may not copy or reverse engineer the Service except as permitted by law. Generated outputs may be subject to third-party rights or restrictions depending on your inputs and applicable law. Punpic does not grant you rights you do not already have.
  9. Third-party services The Service relies on third parties (e.g., AI/API providers and Stripe). Your use may be subject to their terms and policies.
  10. Termination You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, if required by law, or to protect the Service and users.
  11. Disclaimers THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." PUNPIC DISCLAIMS ALL WARRANTIES TO THE MAXIMUM EXTENT PERMITTED BY LAW, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
  12. Limitation of liability TO THE MAXIMUM EXTENT PERMITTED BY LAW, PUNPIC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.
  13. Indemnification You agree to defend and indemnify Punpic from claims arising out of your content, your use of the Service, or your violation of these Terms or third-party rights.
  14. Changes We may update these Terms. If changes are material, we will provide reasonable notice (e.g., in-app notice).

  1. Governing law and jurisdiction These Terms are governed by the laws of the United States, without regard to conflict of laws principles. You agree that disputes will be handled in an appropriate U.S. jurisdiction, unless applicable law requires otherwise.
